Terms of Service

These Terms of Service ("Terms") govern your use of the FIKOKID mobile application (the "App") provided by Octathorn Technologies ("we", "us", "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.

About FIKOKID

FIKOKID is a free educational short-video app designed for children. It offers age- appropriate videos, quizzes and interactive learning activities across a range of topics. The App is offered free of charge and contains no advertisements and no in-app purchases.

Who Can Use FIKOKID

FIKOKID is intended for children, and it is designed to be used under the supervision and with the consent of a parent or legal guardian. By allowing a child to use the App, a parent or guardian accepts these Terms on the child's behalf and is responsible for supervising the child's use of the App.

Licence to Use the App

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use the App on devices you own or control, solely for personal, non- commercial purposes and in accordance with these Terms and the rules of the app store from which you obtained it.

Acceptable Use

When using FIKOKID, you agree that you will not:

• Copy, modify, distribute, sell, or lease any part of the App or its content.
• Reverse engineer, decompile, or attempt to extract the source code of the App, except where such restriction is prohibited by law.
• Use the App in any way that is unlawful, harmful, or that disrupts its operation.
• Attempt to gain unauthorised access to the App, our systems, or the networks connected to them.

Content & Intellectual Property

The App and its original content, features, branding, the "Fiko" character, and design are owned by Octathorn Technologies or its licensors and are protected by intellectual-property laws. Some videos are made available through third-party platforms (such as YouTube's embedded player) and remain the property of their respective owners.

You may not use our name, logo, or the Fiko character without our prior written permission.

Third-Party Services

The App relies on certain third-party services to function — including YouTube and Google (for embedded video playback and fonts) and Meta Platforms (for advertising measurement). Your use of the App may therefore also be subject to those providers' terms and policies. We are not responsible for the content, practices, or availability of third-party services.

Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we handle information in connection with the App. The App has no user accounts, and most information is stored only on the device.

Disclaimers

The App is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that its content will always be accurate or up to date. While FIKOKID is designed to be educational and child-appropriate, we do not guarantee any particular learning outcome.

Limitation of Liability

To the maximum extent permitted by law, Octathorn Technologies shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of, or inability to use, the App. Because the App is provided free of charge, our total liability in connection with the App shall not exceed the amount you paid to use it, which is zero.

Changes to the App and These Terms

We may update, modify, or discontinue the App or any part of it at any time. We may also update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above and, where appropriate, within the App. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

Termination

You may stop using the App at any time by uninstalling it. We may suspend or terminate your access to the App if you breach these Terms or if we discontinue the App. Uninstalling the App removes all locally stored information.

Governing Law

These Terms are governed by the laws applicable to Octathorn Technologies in the jurisdiction in which it is established, without regard to conflict-of-law principles. Any disputes arising from these Terms or the App will be subject to the courts of that jurisdiction.
